Terms & Conditions
These Terms & Conditions (“Agreement”) apply to all bookings with Safari MotoXpedition (“we,” “us,” “our”). By booking a tour, you (“participant,” “you”) agree to the following:
1. Booking and Payments
A booking is confirmed once we receive a non-refundable deposit of 30% of the total tour price.
The remaining 70% balance must be paid no later than 60 days before the tour start date.
Bookings made within 60 days of the tour start must be paid in full at the time of booking.
Payments must be made in the currency specified on the invoice. Any bank fees are the responsibility of the participant.
2. Cancellations and Refunds
By participant:
More than 90 days before tour start: refund of payments made, less the deposit.
60–89 days before tour start: 50% refund of total tour price.
Less than 60 days before tour start: no refund.
By Safari MotoXpedition:
We reserve the right to cancel a tour for reasons including but not limited to safety concerns, insufficient participants, force majeure, or governmental restrictions.
In such cases, participants will receive a full refund of payments made. No further liability will be accepted.
3. Changes to Itinerary
We make every effort to operate the tour as described. However, routes, accommodations, activities, and schedules may change due to weather, road conditions, political situations, or other factors beyond our control. We reserve the right to make necessary changes without prior notice.
4. Participant Responsibilities
You must hold a valid motorcycle license and be able to safely operate a motorcycle.
You must be in suitable physical condition for multi-day motorbike travel.
You are responsible for obtaining a valid passport, visa, and vaccinations required for entry into Kenya.
You must follow the instructions of guides and staff at all times. Failure to do so may result in removal from the tour without refund.
You are responsible for bringing your own motorbike riding gear (helmet, boots, protective clothing, gloves).
5. Insurance
All participants are required to have comprehensive travel insurance covering:
Medical expenses,
Emergency evacuation,
Repatriation,
Trip cancellation.
Proof of insurance must be provided before the start of the tour. Participants without adequate insurance will not be permitted to join.
6. Liability and Risk Acknowledgment
Motorbike travel in Kenya involves inherent risks, including but not limited to: accidents, wildlife encounters, road hazards, illness, weather, and political unrest.
By booking, you acknowledge these risks and agree that Safari MotoXpedition, its staff, and partners are not liable for loss, injury, damage, or death except in cases of proven negligence.
You participate voluntarily and at your own risk.
7. Force Majeure
We are not liable or responsible for failure to perform due to circumstances beyond our control, including natural disasters, pandemics, strikes, wars, or government restrictions.
8. Complaints
Any complaints during the trip must be raised immediately with the tour leader. If not resolved, complaints must be submitted in writing within 14 days of the end of the tour.
9. Governing Law
This Agreement shall be governed by and interpreted under the laws of the country where Safari MotoXpedition is legally registered.
10. Acceptance of Terms
By paying the deposit, you confirm that you have read, understood, and agreed to these Terms & Conditions.
